Project description

How do healthcare professionals interpret and apply the healthcare regulations' vague provisions on the legal status of children? In their daily work, healthcare professionals are expected to understand and apply the medical regulations, which are very general and ambiguous. This applies in particular to the provisions relating to the legal status of children in healthcare. In accordance, healthcare professionals meet a number of interpretive problems. For example, what content should be included in the concept of "the best interest of the child"?

In this project a lawyer and legal researcher participates in the children's healthcare at Skåne County Council. The purpose is to investigate closely how the applied law emerges the practical activities and how routines and governing documents can be design in accordance with the rule of law. Theories on legal realism are applied in the project, which has an exploratory approach, where sociology of law and ethnographic methods are combined.
